JUROR PARKING

A parking pass is mailed with your reminder letter a few days prior to your term of service starting. The pass is valid in any public parking area, except for the following: DO NOT PARK in areas marked for "permit only" parking. Also, DO NOT park along yellow curbs, crosswalks, or restricted parking areas. If you display the pass improperly and receive a ticket you will be responsible to pay the ticket. The pass is valid for the entire trial / term of service. THE PASS IS FOR USE ONLY WHILE ON JURY DUTY. It must be placed on the inside windshield, curb side of the vehicle.

FELON CRIMINAL CONVICTION

Pursuant to Idaho Code section 3, article VI, the Court will dismiss anyone that has been convicted of a felony and is currently on probation/parole and who has not been restored to the rights of citizenship pursuant to section 18-310, Idaho Code or other applicable law. Upon “final discharge”, a person convicted of any Idaho felony shall be restored the full rights of citizenship. “Final discharge” means SATISFACTORY completion of imprisonment, probation and parole as the case may be. The right to ship, transport, possess or receive a firearm is not restored.
Persons convicted of felonies in other states or jurisdictions shall be allowed to serve on jury duty and vote in Idaho upon final discharge which means SATISFACTORY completion of imprisonment, probation and parole. You must provide proof of a satisfactory judgment. You can contact that State (records keeper) you were charged in and ask them for said proof. It may be sent to the addresses below.

FULL TIME STUDENT-NEED PROOF

If you are a student, Pursuant to Idaho Code 2-209 the Court will dismiss anyone that is currently a FULL TIME student, attending a college or University and NOT RESIDING in Bonneville County. Please send a copy of your student I.D. or school registration and a copy of your student housing or rental agreement to prove that you are a FULL TIME student and are NOT RESIDING in Bonneville County. We cannot excuse you from Jury Duty until you send proof to the Court. Our office must receive said proof within ten (10) days or you will be recalled for the next available date of service.

STUDENT still residing in Bonneville County - NOT RELEASED

Anyone attending High School or College in BonnevilleCounty, or another county and still residing in Bonneville County will not be dismissed from Jury Duty. We cannot excuse you from Jury Duty at this time. Your teachers are required to give you your assignments as needed as well as any excused absences for serving on Jury Duty should you have to report to the Court for said Jury Duty. Please advise your professors that you have jury duty. We have found that they are understanding in working with you to complete your civic duty as well as make up work for classes. You can postpone your term of service to a time that may work better but you will not be released.

JURY PAY

In the State of Idaho jurors are compensated for jury service as provided in Idaho Code 2-215.  The per diem rate is established by the county commissioners in the county where the juror resides.  In Bonneville County jurors are paid $5.00 for half a day and $10.00 for a full day of Jury Service.  They are paid for mileage from their residence.

If a juror chooses not to receive payment, please indicate on your Jury Qualification Questionnaire by checking the box.  Your fees and mileage will be donated to Jury Assistance Funds.

LATE RETURN OF JURY SUMMONS - RECALLED

Your Juror Qualification Form needs to be mailed to us within the ten (10) days as instructed on your Juror Summons Affidavit. It is imperative that the Qualification Forms are returned to us in due time for processing. If we do not receive the summons in time, you are not eligible for that term of service. Do not call on that term of service. You will be recalled for the next term of service. A new summons, questionnaire and reporting number will be sent to you.           

THE NEW QUESIONNAIRE MUST BE COMPLETED AND RETURNED TO THE COURT WITHIN TEN (10) DAYS OF RECEIPT.

LOST JURY SUMMONS

If you lose your summons and cannot return the Questionnaire, you are to notify my office that your Jury Summons has been lost. You will be summoned for the next available term of service for Jury Duty. A new summons, questionnaire and reporting number will be sent to you thirty days in advance of service date. THE NEWQUESIONNAIRE MUST BE COMPLETED AND RETURNED TO THE COURT WITHIN TEN (10) DAYS OF RECEIPT.

MEDICAL EXCUSE

The state of Idaho and Bonneville County recognizes NO MEDICAL EXCUSE from jury service except for severe medical problems which MUST BE SUPPORTED BY A DOCTOR’S CERTIFICATE.

If you are requesting a medical excuse from Jury Service, you will need to submit the necessary documentation from a medical physician for this consideration. Your request cannot be granted until said letter is received. Please have your physician fax the medical release to 208-524-7915. You will be recalled for the next available term of service if we do not receive your medical excuse from your physician within ten(10) days.   It must be on the physician’s letter head and signed by the doctor. If you wish to submit other paper work please notify my office so we can review what you have and discuss it.

MILITARY - Need Proof

If you (spouse) are in the active military and are currently stationed out of Bonneville County you will need to provide proofto the court that you (spouse) are in the Military. Please provide a copy of your military ID or papers. We will also need your current mailing address. Please send to one of the addresses below. If the Court does not receive such proof, we will not be able to dismiss you and you will be recalled for the next term of Jury Service.

MISSION - Need Proof

Anyone that is on a Mission must show proof to the court before they can be released from Jury Duty. Please have your church (Pastor or Bishop) send a letter (on letterhead) of confirmation to any one of the addresses provided. They will be recalled for the next available date of service if we do not receive proof that you are on a mission within ten (10) days.

NOT A RESIDENT OF BONNEVILLE COUNTY - NEED PROOF

If you are not a resident of Bonneville County you must show proof of non-residency.  Therefore, disqualification cannot be granted until you show proof to the Court that you are not a resident of Bonneville County.  Please send a copy of your new driver’s license or voter registration from the county where you currently reside.  If our office does not receive proof you will be recalled for the next available term of service. 

NOT A U.S. CITIZEN - NEED PROOF

If you are not a citizen of the United States you mustshow proof to the court that you are not a citizen. Please send a copy of your non-resident card, green card, I-94, Visa, or passport. You will be recalled for the next available date of service if we do not receive proof that you are not a citizen within ten (10) days. The documentation you provide must be signed by the juror and dated. Please return it to one of the addresses provided below.

POSTPONEMENT OF JURY SERVICE DATES

The information for postponing is on the questionnaire of your summons. A request for postponement must be submitted in writing. Please indicate the reason for postponement and indicate a date within the next four (4) months when you will be available. If you cannot mail the summons to us the request may be sent to one of the addresses below. It must be signed and dated.   ONLY ONE POSTPONEMENT WILL BE GRANTED. A new summons, questionnaire and reporting number will be sent to you thirty days in advance of the term of service. THE NEW QUESTIONNAIRE MUST BE COMPLETED AND RETURNED TO THE COURT WITHIN TEN DAYS OF RECEIPT.

PREVIOUS JUROR 

If you have served as a Juror within the last two (2) years, Idaho Code 2-216 states that a person that has SERVED or Attended Court shall not be required to serve more than once during any two (2) year period.  Bonneville County has current ruling that if you have SERVED or Attended Court within the last five (5) years, the juror shall not be required to serve more than once during any five (5) year period.  Your jury service is for a two week term in Bonneville County.  If our records indicate that you have served within five (5) years you will be excused from Jury Service.

SEVENTY YEARS OF AGE - RELEASED

Pursuant to Idaho Code 2-209, the Court will dismiss anyone seventy (70) years of age or older who submits a statement in writing requesting to be excused from Jury Service. You will need to mark of on the questionnaire on the jury summons sent to you that you are seventy years of age or older and wish to be excused. It MUST BE SIGNED, DATED and returned to my office.

If you decide in the future that you wish to be reconsidered for Jury Service you must write a letter to that effect.

WORK OUT OF TOWN FULL TIME And/Or LONG DISTANCE TRUCK DRIVER

If you work out of town full time and/or are a long distance truck driver and there are circumstances which would make it difficult or impossible to perform Jury Service for the term assigned on your summons, the Jury Commissioner requires that you please submit a written request for postponement within ten (10) days. Please give us ONE WEEK within the next six months, which you will be available for Jury Service. The request must be in writing, signed and dated.   If our office does not receive your written request for postponement within ten days, you will be recalled for the next available date of service. You can mail it to the addresses provided below.

NON-RETURNED JUROR QUALIFICATION FORM

A Juror Qualification Form is mailed to you to and is to be completed and returned to our office within ten (10) days. If our records indicate that we have not received your completed Juror Questionnaire for that assigned term of service as ordered by the court you will receive a letter from us. THEREFORE, PURSUANT TO IDAHO CODE, SECTION 2-208 (2), YOU ARE HEREBY ORDERED TO IMMEDIATELY COMPLETE AND RETURN THE JUROR QUALIFICATION FORM OR APPEAR BEFORE THE JURY COMMISSIONER AT THE BONNEVILLE COUNTY COURTHOUSE, 605 NORTH CAPITAL AVENUE, IDAHO FALLS, IDAHO WITH AN EXPLANATION. You will be recalled for the next available term of service if we do not receive your jury summons on time. Please make sure your next summons is completed and returned to our office within ten (10) days. After three mailings and still no response, you will be ordered to appear before the Judge for order to show cause and explain why you have not complied with jury service. You could be facing a $300 fine and or three (3) days in jail. If you have a change of address, it is the juror's responsibility to notify our office of your new address. JURY SELECTION PROCESS

TERMS OF SERVICE:
Your term of jury service is listed on the summons you received in the mail.  Any citizen impanelled as a juror, serves for the duration of that trial, however long that trial may last. 

HOW IS A JUROR SELECTED?
Jurors are selected in accordance with Idaho Code 2-206.  Names are drawn from the voter registration and driver’s license files.

WHAT DO I DO NOW?

1)      RETURN JURY QUALIFICATION QUESTIONNAIRE (Note: this may be done online but you will have to copy and attach it to an email or print it out and fax it)
2)      Summons (read and follow CALL-IN instructions)
3)      Call-in, listen for reporting numbers and instructions.  Call 529-1347 as instructed on your summons.  Please listen to the entire message.
4)      Report for orientation and jury service as directed or call again as directed.

SECURITY
Security if mandatory in all court facilities.  Please do not bring any items that could be construed as a weapon such as guns, pocket knives, mace, scissors, razor blades, crochet hooks, knitting needles and other metal objects.  These items will delay the security check-in.

DRESS
Jurors should appear dressed in a manner that is respectful of the Court.  Uniforms, shorts, and improper clothing are not acceptable.  Be on time, allow the entire day for your jury service.

PARKING
A parking pass with complete instructions on where to park will be mailed to you a few days prior to your beginning date of Jury Service.  Please read it and park as instructed. 

SPECIAL ASSISTANCE
If you have any need for any other special assistance i.e. hearing aide devices, wheel chair access, service dogs, etc. please notify our office at least two days prior to starting if possible.  If you need an interpreter for any language other than the English language, please notify the Jury Commissioner’s Office at least two weeks prior to starting your service.

CAUSES FOR MISTRIAL

You can unknowingly cause a mistrial, so please do not talk to anyone about the case assigned to a trial.  Also, law books, dictionaries, newspapers and medical books are not allowed in the court room.  Jurors may not ask questions during the course of the trial.  Your only opportunity to talk is when you are questioned during the voir dire questioning, which is the formal jury selection process.

DO NOT BRING CHILDREN TO JURY SERVICE.  Family members are allowed if necessary for your personal assistance.

If you are serving on a jury trial in a courtroom, and an emergency occurs, your family members may contact the Jury Commissioner’s office at 529-1350 ext. 1902 or 1907.  If no answer call 529-1350 ext. 1346 for further assistance (note: emergencies only).
